Roundtable for the Judges of Administrative Courts from Serbia and Montenegro

The OECD/SIGMA organized the Roundtable for the Judges of Administrative Courts from Serbia and Montenegro on February 13, 2026 in Belgrade. During her speech, the President of the Administrative Court Judge Radojka Marinković emphasized the significance of the silence of administration institute, and the risk of the abuse of rights in its legal definition through the fulfilment of its procedural prerequisites. She also presented the current situation in the Administrative Court in relation to a large number of administrative disputes arising from the silence of administration, the experiences of the Court and measures that the Court had undertaken in order to solve identified issues. She particularly emphasized the obligation to maintain the balance between the citizens’ rights, efficiency of the Court and prevention of the abuse of rights. The President of the Administrative Court of Montenegro Judge Miodrag Pešić presented experiences and undertaken measures aimed at resolution of a large number of disputes arising from the silence of administration in Montenegro.

The OECD/SIGMA experts: Judge Edith Zeller (judge at the Administrative Court of Vienna) and Judge Andrej Kmecl (judge at the Supreme Court of the Republic of Slovenia) spoke about experiences of judicial authorities in the EU member states in similar situations. In the end, the participants of the event had a discussion on problematic issues and possibilities to resolve the challenges related to an enormous number of claims on the grounds of silence of administration in Serbia and Montenegro. The following judges from the Administrative Court of the Republic of Serbia participated in the Roundtable: Gordana Bogdanović, Vera Marinković, Vesna Čogurić, Jelena Nikolić, Nataša Kocić Filipović, Biljana Stojanović, Slobodan Marijan, Ljiljana Koruga and Vesna Slijepčević.
